Ecuadorian Court Rules Against Former Vice President’s Detention at Mexican Embassy

In a ruling, the Ecuadorian court has declared the detention of former vice president Jorge Glas at the Mexican Embassy in Quito to be “illegal” and “arbitrary.” However, despite this ruling, Glas remains in prison as he has not yet completed an eight-year sentence for previous convictions. The court found that Glas’s rights were violated because the Ecuadorian State did not follow the established procedure for operations in diplomatic missions. Despite this violation, the court denied Glas’s request for habeas corpus, which sought to annul his detention and be handed over to Mexico or another country that would grant him asylum.

Glas was sentenced to six years in prison in 2017 for illicit association in the Odebrecht case and to eight years in prison in 2020 for receiving bribes. Despite serving almost five years between 2017 and 2022, Glas had not completed his sentences. Additionally, he is now facing charges for embezzlement of public funds related to reconstruction works following a 2016 earthquake. In December 2023, he sought asylum at the Mexican Embassy in Quito, claiming political persecution and denial of justice. The Mexican government granted him asylum, but Ecuador considered it illegal and a violation of international conventions. Following the asylum grant, Ecuadorian authorities stormed the embassy and arrested Glas. He is currently being held in La Roca, a maximum-security prison in Ecuador, where he has claimed to be a victim of torture during his arrest.

While the court upheld the arrest warrant issued for Glas, it found no responsibility on the part of Ecuadorian government officials for the asylum granted by Mexico. Despite this ruling and ongoing discussions about his fate between Mexico and Ecuadorian authorities, Glas remains imprisoned serving his sentences for previous convictions.
