A new class-action lawsuit has been filed against the popular soda brand Poppi, alleging that their products do not improve gut health as much as their marketing claims. The lawsuit was filed by a consumer named Kristin Cobbs in U.S. District Court in San Francisco, who purchased Poppi drinks based on their labels that claim to be prebiotic sodas.

Cobbs’ attention was caught by the slogan “Be Gut Happy. Be Gut Healthy,” but after further examination, she found that the drinks only contain around 2 grams of prebiotic agave inulin fiber, which she believes is not enough to provide real benefits. Research cited by Cobbs shows that consuming 7.5 grams of agave inulin daily for three weeks is necessary to confer any meaningful prebiotic benefits, which is not the case with Poppi drinks.

The lawsuit also mentions that increased sugar consumption from drinking more Poppi would outweigh any potential prebiotic benefits. Cobbs is seeking monetary relief for herself and other similar customers who may have been misled by the brand’s claims.

Poppi, based in Austin, Texas, has released a statement standing behind their products and claiming that they are on a mission to revolutionize soda for a new generation of drinkers. They have innovated to provide a popular tasting experience that millions of people enjoy. The company believes that the lawsuit is baseless and plans to vigorously defend against the allegations.

Poppi is one of many brands in the growing functional beverage category, which claims to improve health and wellness. Sales of prebiotic and probiotic drinks tripled last year in the U.S., according to data from consulting firm AlixPartners.
