Ohioans voted to legalize recreational marijuana on November 7, with nearly 57% of the state’s population supporting the initiative. As a result, Ohio became the 24th state to allow adults over the age of 21 to possess up to 2.5 ounces of marijuana and grow up to six plants per person and 12 per household.
However, not all communities in Ohio are welcoming marijuana businesses with open arms. Clearcreek Twp., located in Ohio, is considering a zoning code amendment that would prohibit marijuana businesses from operating within the township. The proposed resolution sets definitions and standards for medical and residential marijuana and bans cannabis operators, cultivators, and processors in all zoning classifications within the township.
The new zoning language aligns with definitions outlined in state law, but this has not deterred some residents from voicing their opposition to marijuana businesses coming into their community. According to results from the Warren County Board of Elections, Issue 2 failed in many precincts within Clearcreek Twp., indicating that some trustees may be hesitant about allowing pot shops and processing facilities within their jurisdiction.
Other cities in Ohio have also enacted similar moratoriums on marijuana businesses, including Centerville, Kettering, Springboro, Beavercreek, Miamisburg, West Carrollton, Franklin, Xenia, Waynesville
