The state of Colorado is taking steps to better support children and youth in the foster care system with complex behavioral health needs, as Governor Jared Polis signed legislation yesterday. The bipartisan bill, sponsored by Representatives Mary Young and Brandi Bradley, aims to increase the availability of residential treatment centers and beds for foster children with behavioral health needs.

The Child Welfare System Interim Study Committee made recommendations that led to the creation of this legislation, which aims to strengthen the system of care by expanding residential care options, investing in more treatment beds, and providing training for staff to better support foster care youth. By reducing reliance on treatment beds and providing a more comprehensive system of care for children and youth in foster care, the goal is to improve access to care.

HB24-1038 outlines a system of care specifically designed for youth and children with complex behavioral health needs in foster care or at risk of out-of-home placement. State agencies are required to create care plans that include standardized assessments, intensive care coordination, supportive services, and expanded access to treatment for foster care youth.

To address the needs of foster youth, the legislation establishes a training academy to develop high-quality residential child care providers. These providers will ensure effective, safe, and responsible care for youth in residential settings. The law also mandates state monitoring of quality standards for residential child care providers at all levels of care.
