In a major victory for consumers, Alabama Attorney General Steve Marshall successfully obtained a temporary restraining order against Legend Windows, LLC for deceiving customers into making deposits for windows and doors that were never delivered. The court granted the restraining order, which covers individuals associated with the business, including Jody Ray Whitworth, Bobby Ray Whitworth, and Robin Simmons Willard. The order includes an asset freeze and prohibits the business from operating while the legal system reviews the case.
Marshall emphasized the importance of holding Legend Windows and the Whitworths accountable for their fraudulent activities, stating that they have exploited their customer base for too long. The defendants have a history of property theft and have continuously engaged in deceptive practices without remorse.
The state’s complaint alleges that Legend Windows violated the Alabama Deceptive Trade Practices Act on 42 occasions, impacting over 40 victims across the state who are collectively owed $181,042.80 in damages. Jody Whitworth is accused of misusing customer payments for personal purchases instead of fulfilling the promised products and services.
Between September 2022 and March 2024, it was discovered that Legend Windows made over 1,100 purchases from Amazon totaling approximately $50,000. Additionally, the business made purchases from various retailers such as Temu, Etsy, JCPenney, TJ Maxx, Ross, Marshalls
