Israel and Hamas leaders have been requested arrest warrants by the Prosecutor of the International Criminal Court. Charges of war crimes and crimes against humanity, including “starvation,” “premeditated murder,” and “extermination and/or murder,” have been brought against Israeli officials Prime Minister Benjamin Netanyahu and Defense Minister Yoav Galant. Similarly, arrest warrants have been requested against Hamas leaders Yahya Al-Sinwar, Muhammad Diab Ibrahim, and Ismail Haniyeh on charges of “genocide,” “rape,” and “hostage taking.”

The impact of these requests has already been felt, with many countries expressing their support or opposition. The next step is for a panel of three judges to decide whether the evidence meets the criteria for issuing arrest warrants. While the International Criminal Court does not have its own police force to enforce these warrants, member states are not obligated to arrest the individuals if they visit their territory. However, traveling to EU countries may prove difficult for the targeted individuals.

Past cases have shown that political and military leaders can be tried for war crimes and crimes against humanity. While legal procedures can be lengthy, it is possible that what may seem impossible today could become feasible in the future. The decision on whether to issue arrest warrants for the Israeli and Hamas leaders will be made by the Pre-Trial Chamber after careful consideration of the evidence presented. It remains to be seen how this situation will unfold and what implications it will have on the international stage.
